How to file a case on Najiz?

Najiz is an electronic platform launched by the Saudi Ministry of Justice to file a lawsuit or court case. The process of filing a lawsuit on Najiz differs according to the nature of the case. 

Filing Labor Cases

To file a lawsuit against your employer or Kafeel in Saudi Arabia, follow this process;

• Submit an online complaint to Saudi Labor Courts.

If any parties are unsatisfied with the decision made by the labor court, they can file a case on the Najiz platform within 30 days. Here is the process;

• Open Najiz: https://najiz.sa/applications/landing
• Click on “دخول” i.e. Log in.
• Enter Iqama Number.
• Approve Nafath access.

After successfully entering the Najiz platform,

• Click on 4 blocks as shown below.
• Select القضاء service, which means Judiciary.
• Select الاعتراض على الحكم option i.e. Objection to the ruling.
• Click on “تقديم طلب جديد“. i.e. submit a new application.

A new page will open where you need to click on “طلب جديد” to file the case against your employer. Although you can file the case yourself, it is better to obtain the services of a lawyer or at least an Arabic-speaking person.

For example, in case of an illegal termination by the employer where he is not paying the benefits under Article 77 of Saudi Labor Law, you can fill the following;

• تصنيف الدعوى الرئيسية: عمالية
• التصنيف الفرعي للدعوى: تعويض 
• نوع الدعوى: إنهاء العلاقة العمالية من صاحب العمل
• Complete the rest of the process and attach the documents to submit the case.

Court case against the landlord

To file a lawsuit against your landlord on Najiz platform, follow this process.

• Open Najiz: https://najiz.sa/applications/landing
• Select القضاء service, which means Judiciary.
• Click on “صحيفة الدعوى” i.e. lawsuit.
• Click on “تقديم طلب جديد“. i.e. submit a new application.

A new page will open where you need to click on “طلب جديد” to file the case against your landlord.

• تصنيف الدعوى الرئيسية: عامة
•  التصنيف الفرعي للدعوى: عقارية
• نوع الدعوى: إخلاء عقار

Complete the rest of the process and attach the documents to submit the case.

A court case for traffic accidents

In case of traffic accident, if the other party fails to pay the damage caused by his mistake, you can file a lawsuit on Najiz against that person.

• Select القضاء service, which means Judiciary.
• Click on “صحيفة الدعوى” i.e. lawsuit.
• Click on “تقديم طلب جديد“. i.e. submit a new application.

A new page will open where you need to click on “طلب جديد” to file the case against that person.

• تصنيف الدعوى الرئيسية: عامة
•  التصنيف الفرعي للدعوى: مروري
• نوع الدعوى: حق خاص ناشئ عن حادث مروري
• Claim traffic accident damages if the other party doesn’t have insurance.

Execution Courts

If the court verdict was in your favor, but the defendant has failed to pay the amount within the required time, you must file a case with the implementation courts in Saudi Arabia through Najiz. To do that;

• Open Najiz: https://najiz.sa/applications/landing
• Click on “دخول” i.e. Log in.
• Enter Iqama Number.
• Approve Nafath access.
• Select “التنفيذ” i.e. Execution.
• Click on “طلب التنفيذ” i.e. Execution Request.
• Select “تنفيذ مالي” i.e. Financial Execution.
• Upload all the case documents.
• Provide the IBAN number of your bank.

If the company fails to settle the amount mentioned in the judgment, the enforcement court will take the following steps one by one;

1. Send a message to the employer to settle the dues.
2. Publicize the employer’s responsibility to pay off the dues in a local newspaper.
3. Stop the Labor office services for the employer, i.e., no Iqama renewal for staff.
4. Freeze the settlement amount from the bank account.
5. Attach the employer’s assets, sell them, and pay the employee.
